Regulation on Prescribed Format for Electronic Access to Personal Health Information

The Ministry of Health has developed a draft regulation to support patient and caregiver digital access to personal health information. This draft regulation aims to enable existing PHIPA provisions that stipulate the right to access the record in an electronic format by specifying the format as PDF (with exemptions available should the generation of the PDF cause undue hardship on health information custodians). The PDF is a format easily accessible by patients and caregivers, and can be easily generated by many point-of-care systems and basic office hardware.

Overall, this proposed regulation is intended to be an interim measure to allow for electronic access to PHI. At a later date, the regulation will be amended to enable patients to access their PHI in a format that allows them to download, transfer, and analyze their data. The proposed regulation is currently posted in the Regulatory Registry for public consultation from October 16 to December 15, 2021. At this time, we are looking to gather feedback from our stakeholders as part of the regulation development process.

Paul has extensive experience working in the Ontario Public Service (OPS) in Treasury Board Secretariat and the Ministry of Health. Previous to joining the OPS, he was a management consultant for clients including the National Health Service and the World Bank. More recently, he has advised regional and national governments in United Arab Emirates on digital government.

Jessica has been part of the Digital Health Program Branch for 7 years, working on projects such as the Digital Health Playbook and assisting in the development of the Digital First for Health strategy. Previous to joining the OPS, she completed a Master’s degree in International Comparative Education from Stanford University.
